{"id":81,"date":"2025-06-08T06:58:09","date_gmt":"2025-06-08T06:58:09","guid":{"rendered":"https:\/\/mazala-travel.com\/kr\/?page_id=48"},"modified":"2025-06-08T06:58:09","modified_gmt":"2025-06-08T06:58:09","slug":"agreement","status":"publish","type":"page","link":"https:\/\/mazala-travel.com\/kr\/agreement\/","title":{"rendered":"Tour Service Agreement"},"content":{"rendered":"\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-7387b849 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:15%\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:70%\">\n<h1 class=\"wp-block-heading\"><strong>TOUR SERVICE AGREEMENT<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Between: Digital Consulting Service LLC (Mongolia)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>And: The Tourist\/Client<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>PREAMBLE<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This legally binding agreement (\u201cAgreement\u201d) governs the relationship between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Digital Consulting Service LLC<\/strong>, a legally registered company in Mongolia, operating under the trade name \u201cMazala Travel\u201d and referred to as the \u201cProvider\u201d or \u201cMazala Travel\u201d;and<\/li>\n\n\n\n<li>The individual traveler or group representative booking or participating in a travel service, referred to as the \u201cClient,\u201d \u201cTraveler,\u201d or \u201cParticipant.\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Invoicing, payment collection, and financial administration related to bookings under this Agreement are conducted through&nbsp;<strong>Mazala Limited<\/strong>, a private limited company incorporated in Hong Kong.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>SECTION I:&nbsp;<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\ud83e\udded<\/strong>&nbsp;<strong>GENERAL TERMS &amp; CONDITIONS<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.1 CONTRACTUAL RELATIONSHIP<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Upon confirmation of any itinerary, service, or tour package through deposit or full payment, the Client enters into a binding service agreement with&nbsp;<strong>Digital Consulting Service LLC<\/strong>. This includes full acceptance of all terms in this contract, including any linked booking policies, disclaimers, and referenced documents.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.2 SCOPE OF SERVICES<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel organizes and provides:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Multi-day guided and semi-guided tour packages<\/li>\n\n\n\n<li>Cultural, recreational, and outdoor activities<\/li>\n\n\n\n<li>Accommodation, ground transportation, and entry tickets<\/li>\n\n\n\n<li>Tour planning, concierge, and coordination<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Services are delivered directly or via contracted local suppliers, who are vetted and bound by Mazala Travel\u2019s quality and ethics standards.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.3 BOOKING ELIGIBILITY<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">To book a tour, the Client must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Be at least 18 years old (or booking on behalf of a minor with legal authority)<\/li>\n\n\n\n<li>Be legally able to travel and enter the designated destinations<\/li>\n\n\n\n<li>Acknowledge their full physical, mental, and legal capacity to undertake the trip<\/li>\n\n\n\n<li>Accept the terms of this Agreement<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Group bookings made by a representative are considered binding on all participants listed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.4 REQUIRED DOCUMENTS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Client agrees to provide, at their own cost:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A valid passport with at least 6 months\u2019 validity<\/li>\n\n\n\n<li>Required visas or entry permits<\/li>\n\n\n\n<li>Travel insurance documentation<\/li>\n\n\n\n<li>Consent forms, medical disclosures, or waivers, if applicable<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel is not responsible for denied entry due to incomplete documentation or immigration issues.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.5 ITINERARY CHANGES<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel reserves the right to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Alter, postpone, or substitute elements of the itinerary for operational, safety, or weather-related reasons<\/li>\n\n\n\n<li>Replace unavailable accommodation or services with equal or higher-quality alternatives<\/li>\n\n\n\n<li>Cancel or reschedule tours based on minimum group size requirements or guide\/vehicle availability<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Advance notice will be provided, and all efforts made to preserve the trip value.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.6 CODE OF CONDUCT<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Clients agree to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Show respect to guides, service staff, fellow travelers, and host communities<\/li>\n\n\n\n<li>Follow guide instructions, activity safety briefings, and environmental regulations<\/li>\n\n\n\n<li>Avoid culturally inappropriate behavior, illegal activities, or disruptive conduct<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel reserves the right to remove any Client from a tour without refund for violation of these terms.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.7 MINORS AND GUARDIANSHIP<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Minors under 18 must travel with a parent, guardian, or approved chaperone. Travel without both parents requires notarized consent (see Child Travel Consent Policy). Guardians are fully responsible for all decisions, risks, and behavior of accompanying minors.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1.8 SUBCONTRACTED SERVICES<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Certain services (e.g., accommodations, transportation, guides) may be delivered by third-party providers. While Mazala Travel vets and contracts these partners, it cannot guarantee performance and is not directly liable for third-party negligence or failures beyond its control.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>SECTION II:&nbsp;<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\ud83d\udee1\ufe0f<\/strong>&nbsp;<strong>INSURANCE AND RISK ASSESSMENTS<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.1 MANDATORY INSURANCE<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Client is&nbsp;<strong>required<\/strong>&nbsp;to obtain comprehensive travel insurance that includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Emergency medical care (outpatient and hospitalization)<\/li>\n\n\n\n<li>Medical evacuation and repatriation<\/li>\n\n\n\n<li>Trip interruption and cancellation coverage<\/li>\n\n\n\n<li>Loss or theft of belongings<\/li>\n\n\n\n<li>Personal liability for property damage or injury<\/li>\n\n\n\n<li>Coverage for high-risk activities (as specified in the tour)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Proof of insurance may be requested prior to or during the trip.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.2 VOLUNTARY ASSUMPTION OF RISK<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Client understands and accepts that participation in outdoor, cultural, or adventure travel activities involves inherent risks, including but not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Illness, injury, or death<\/li>\n\n\n\n<li>Altitude sickness or exposure to weather extremes<\/li>\n\n\n\n<li>Remote locations with limited access to emergency services<\/li>\n\n\n\n<li>Accidents during land transport, horseback riding, hiking, or camping<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel takes all reasonable steps to mitigate risks but cannot eliminate them entirely.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.3 MEDICAL FITNESS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Client must disclose:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Known health conditions (e.g., heart disease, asthma, epilepsy, pregnancy)<\/li>\n\n\n\n<li>Recent surgeries, medication requirements, or physical limitations<\/li>\n\n\n\n<li>Dietary allergies or conditions affecting trip safety or experience<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel reserves the right to request medical clearance, exclude the Client from specific activities, or cancel participation for health\/safety reasons.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.4 ACCESSIBILITY AND LIMITATIONS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel will accommodate physical or medical needs&nbsp;<strong>where possible<\/strong>, but cannot guarantee full accessibility across rural, nomadic, or natural destinations in Mongolia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clients with mobility or health limitations must consult with Mazala Travel&nbsp;<strong>before booking<\/strong>, and custom arrangements may be required.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.5 FORCE MAJEURE<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel is not liable for non-performance or partial performance due to force majeure, including but not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Natural disasters (e.g., flooding, earthquake, snowstorm)<\/li>\n\n\n\n<li>Global pandemics, outbreaks, or border closures<\/li>\n\n\n\n<li>Political unrest or conflict<\/li>\n\n\n\n<li>Strikes, supplier bankruptcy, or transportation shutdowns<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In such cases, the Client may be offered:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trip rescheduling<\/li>\n\n\n\n<li>Future travel credit<\/li>\n\n\n\n<li>Refund less unrecoverable third-party costs<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.6 ACTIVITY-SPECIFIC WAIVERS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Client may be required to sign additional liability waivers for activities such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Horseback or camel riding<\/li>\n\n\n\n<li>Trekking or climbing<\/li>\n\n\n\n<li>Camping in remote or high-altitude locations<\/li>\n\n\n\n<li>Nomadic homestays<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Refusal to sign may result in removal from the activity without refund.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>SECTION III:<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\ud83d\udcb3<\/strong>&nbsp;<strong>PAYMENTS AND FINANCIAL TERMS<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.1 PRICING STRUCTURE<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are quoted in&nbsp;<strong>U.S. Dollars (USD)<\/strong>&nbsp;and include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Transportation, accommodation, guide services, meals, entrance fees, and itinerary elements as specified<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Unless explicitly included, prices exclude:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>International flights<\/li>\n\n\n\n<li>Travel insurance<\/li>\n\n\n\n<li>Visa fees, vaccinations<\/li>\n\n\n\n<li>Optional add-ons or personal expenses<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Mazala Travel reserves the right to adjust prices prior to booking confirmation due to currency fluctuations, inflation, or supplier changes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.2 DEPOSIT AND PAYMENT SCHEDULE<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>For all tours:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A\u00a0<strong>30% non-refundable deposit<\/strong>\u00a0is required to secure a booking<\/li>\n\n\n\n<li>The remaining\u00a0<strong>70% balance<\/strong>\u00a0is due\u00a0<strong>no later than 14 calendar days<\/strong>\u00a0prior to departure<\/li>\n\n\n\n<li>Late payment may result in booking cancellation and forfeiture of deposit<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.3 ACCEPTED PAYMENT METHODS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">All payments are invoiced by&nbsp;<strong>Mazala Limited (Hong Kong)<\/strong>&nbsp;and may be made via:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>International bank transfer (USD)<\/li>\n\n\n\n<li>Credit\/debit card (Visa, MasterCard, Amex)<\/li>\n\n\n\n<li>Secure online platforms (e.g., Stripe, LINE Pay, PayPal)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Clients are responsible for all bank fees, exchange rate differences, and transaction charges.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.4 CANCELLATIONS AND REFUNDS (CLIENT-INITIATED)<\/strong><\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th><strong>Notice Period Before Departure<\/strong><\/th><th><strong>Refund Terms<\/strong><\/th><\/tr><\/thead><tbody><tr><td>More than 60 days<\/td><td>100% refund, minus deposit and admin fee (5%)<\/td><\/tr><tr><td>30\u201359 days<\/td><td>70% refund (excluding deposit)<\/td><\/tr><tr><td>14\u201329 days<\/td><td>50% refund (excluding deposit)<\/td><\/tr><tr><td>Less than 14 days \/ no-show<\/td><td>No refund<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Note:<\/strong>&nbsp;All non-recoverable supplier costs (e.g., prepaid hotels, permits) will be deducted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All cancellation requests must be made in writing to&nbsp;<strong><a href=\"mailto:booking@mazala-travel.com\/kr\">booking@mazala-travel.com\/kr<\/a><\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.5 CANCELLATIONS BY MAZALA TRAVEL<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If Mazala Travel cancels due to operational reasons, safety concerns, or force majeure:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Client will receive a full refund or trip credit<\/li>\n\n\n\n<li>Optional services booked independently (e.g., flights) are\u00a0<strong>not covered<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Clients are encouraged to purchase trip cancellation insurance to mitigate such risks.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.6 TRAVEL VOUCHERS AND CREDITS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of rebooking or postponed tours:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Credit is valid for\u00a0<strong>12 months<\/strong>\u00a0from the original departure date<\/li>\n\n\n\n<li>May be transferred to another traveler with written notice<\/li>\n\n\n\n<li>Cannot be exchanged for cash<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.7 DISPUTE RESOLUTION AND JURISDICTION<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Disputes related to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Service delivery or tour conduct<\/strong>\u00a0shall be governed by the laws of\u00a0<strong>Mongolia<\/strong><\/li>\n\n\n\n<li><strong>Invoicing, billing, or financial matters<\/strong>\u00a0shall be governed by the laws of\u00a0<strong>Hong Kong SAR<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a dispute, both parties agree to attempt mediation before seeking litigation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u2705 ACKNOWLEDGMENT AND AGREEMENT<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">By confirming a booking or submitting payment, the Client certifies that they:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Have read and understood this agreement in full<\/li>\n\n\n\n<li>Accept the terms, risks, and responsibilities outlined herein<\/li>\n\n\n\n<li>Are authorized to sign on behalf of all persons listed in the booking<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Mazala Travel<\/strong><br>Operated by:\u00a0<strong>Digital Consulting Service LLC<\/strong><br>Registered in
