TOUR SERVICE AGREEMENT

Between: Digital Consulting Service LLC (Mongolia)

And: The Tourist/Client


PREAMBLE

This legally binding agreement (“Agreement”) governs the relationship between:

  • Digital Consulting Service LLC, a legally registered company in Mongolia, operating under the trade name “Mazala Travel” and referred to as the “Provider” or “Mazala Travel”;and
  • The individual traveler or group representative booking or participating in a travel service, referred to as the “Client,” “Traveler,” or “Participant.”

Invoicing, payment collection, and financial administration related to bookings under this Agreement are conducted through Mazala Limited, a private limited company incorporated in Hong Kong.


SECTION I: 

🧭 GENERAL TERMS & CONDITIONS

1.1 CONTRACTUAL RELATIONSHIP

Upon confirmation of any itinerary, service, or tour package through deposit or full payment, the Client enters into a binding service agreement with Digital Consulting Service LLC. This includes full acceptance of all terms in this contract, including any linked booking policies, disclaimers, and referenced documents.

1.2 SCOPE OF SERVICES

Mazala Travel organizes and provides:

  • Multi-day guided and semi-guided tour packages
  • Cultural, recreational, and outdoor activities
  • Accommodation, ground transportation, and entry tickets
  • Tour planning, concierge, and coordination

Services are delivered directly or via contracted local suppliers, who are vetted and bound by Mazala Travel’s quality and ethics standards.

1.3 BOOKING ELIGIBILITY

To book a tour, the Client must:

  • Be at least 18 years old (or booking on behalf of a minor with legal authority)
  • Be legally able to travel and enter the designated destinations
  • Acknowledge their full physical, mental, and legal capacity to undertake the trip
  • Accept the terms of this Agreement

Group bookings made by a representative are considered binding on all participants listed.

1.4 REQUIRED DOCUMENTS

The Client agrees to provide, at their own cost:

  • A valid passport with at least 6 months’ validity
  • Required visas or entry permits
  • Travel insurance documentation
  • Consent forms, medical disclosures, or waivers, if applicable

Mazala Travel is not responsible for denied entry due to incomplete documentation or immigration issues.

1.5 ITINERARY CHANGES

Mazala Travel reserves the right to:

  • Alter, postpone, or substitute elements of the itinerary for operational, safety, or weather-related reasons
  • Replace unavailable accommodation or services with equal or higher-quality alternatives
  • Cancel or reschedule tours based on minimum group size requirements or guide/vehicle availability

Advance notice will be provided, and all efforts made to preserve the trip value.

1.6 CODE OF CONDUCT

Clients agree to:

  • Show respect to guides, service staff, fellow travelers, and host communities
  • Follow guide instructions, activity safety briefings, and environmental regulations
  • Avoid culturally inappropriate behavior, illegal activities, or disruptive conduct

Mazala Travel reserves the right to remove any Client from a tour without refund for violation of these terms.

1.7 MINORS AND GUARDIANSHIP

Minors under 18 must travel with a parent, guardian, or approved chaperone. Travel without both parents requires notarized consent (see Child Travel Consent Policy). Guardians are fully responsible for all decisions, risks, and behavior of accompanying minors.

1.8 SUBCONTRACTED SERVICES

Certain services (e.g., accommodations, transportation, guides) may be delivered by third-party providers. While Mazala Travel vets and contracts these partners, it cannot guarantee performance and is not directly liable for third-party negligence or failures beyond its control.


SECTION II: 

🛡️ INSURANCE AND RISK ASSESSMENTS

2.1 MANDATORY INSURANCE

The Client is required to obtain comprehensive travel insurance that includes:

  • Emergency medical care (outpatient and hospitalization)
  • Medical evacuation and repatriation
  • Trip interruption and cancellation coverage
  • Loss or theft of belongings
  • Personal liability for property damage or injury
  • Coverage for high-risk activities (as specified in the tour)

Proof of insurance may be requested prior to or during the trip.

2.2 VOLUNTARY ASSUMPTION OF RISK

The Client understands and accepts that participation in outdoor, cultural, or adventure travel activities involves inherent risks, including but not limited to:

  • Illness, injury, or death
  • Altitude sickness or exposure to weather extremes
  • Remote locations with limited access to emergency services
  • Accidents during land transport, horseback riding, hiking, or camping

Mazala Travel takes all reasonable steps to mitigate risks but cannot eliminate them entirely.

2.3 MEDICAL FITNESS

The Client must disclose:

  • Known health conditions (e.g., heart disease, asthma, epilepsy, pregnancy)
  • Recent surgeries, medication requirements, or physical limitations
  • Dietary allergies or conditions affecting trip safety or experience

Mazala Travel reserves the right to request medical clearance, exclude the Client from specific activities, or cancel participation for health/safety reasons.

2.4 ACCESSIBILITY AND LIMITATIONS

Mazala Travel will accommodate physical or medical needs where possible, but cannot guarantee full accessibility across rural, nomadic, or natural destinations in Mongolia.

Clients with mobility or health limitations must consult with Mazala Travel before booking, and custom arrangements may be required.

2.5 FORCE MAJEURE

Mazala Travel is not liable for non-performance or partial performance due to force majeure, including but not limited to:

  • Natural disasters (e.g., flooding, earthquake, snowstorm)
  • Global pandemics, outbreaks, or border closures
  • Political unrest or conflict
  • Strikes, supplier bankruptcy, or transportation shutdowns

In such cases, the Client may be offered:

  • Trip rescheduling
  • Future travel credit
  • Refund less unrecoverable third-party costs

2.6 ACTIVITY-SPECIFIC WAIVERS

The Client may be required to sign additional liability waivers for activities such as:

  • Horseback or camel riding
  • Trekking or climbing
  • Camping in remote or high-altitude locations
  • Nomadic homestays

Refusal to sign may result in removal from the activity without refund.


SECTION III:

💳 PAYMENTS AND FINANCIAL TERMS

3.1 PRICING STRUCTURE

Prices are quoted in U.S. Dollars (USD) and include:

  • Transportation, accommodation, guide services, meals, entrance fees, and itinerary elements as specified

Unless explicitly included, prices exclude:

  • International flights
  • Travel insurance
  • Visa fees, vaccinations
  • Optional add-ons or personal expenses

Mazala Travel reserves the right to adjust prices prior to booking confirmation due to currency fluctuations, inflation, or supplier changes.

3.2 DEPOSIT AND PAYMENT SCHEDULE

For all tours:

  • 30% non-refundable deposit is required to secure a booking
  • The remaining 70% balance is due no later than 14 calendar days prior to departure
  • Late payment may result in booking cancellation and forfeiture of deposit

3.3 ACCEPTED PAYMENT METHODS

All payments are invoiced by Mazala Limited (Hong Kong) and may be made via:

  • International bank transfer (USD)
  • Credit/debit card (Visa, MasterCard, Amex)
  • Secure online platforms (e.g., Stripe, LINE Pay, PayPal)

Clients are responsible for all bank fees, exchange rate differences, and transaction charges.

3.4 CANCELLATIONS AND REFUNDS (CLIENT-INITIATED)

Note: All non-recoverable supplier costs (e.g., prepaid hotels, permits) will be deducted.

All cancellation requests must be made in writing to booking@mazala-travel.com.

3.5 CANCELLATIONS BY MAZALA TRAVEL

If Mazala Travel cancels due to operational reasons, safety concerns, or force majeure:

  • The Client will receive a full refund or trip credit
  • Optional services booked independently (e.g., flights) are not covered

Clients are encouraged to purchase trip cancellation insurance to mitigate such risks.

3.6 TRAVEL VOUCHERS AND CREDITS

In the case of rebooking or postponed tours:

  • Credit is valid for 12 months from the original departure date
  • May be transferred to another traveler with written notice
  • Cannot be exchanged for cash

3.7 DISPUTE RESOLUTION AND JURISDICTION

Disputes related to:

  • Service delivery or tour conduct shall be governed by the laws of Mongolia
  • Invoicing, billing, or financial matters shall be governed by the laws of Hong Kong SAR

In the event of a dispute, both parties agree to attempt mediation before seeking litigation.


✅ ACKNOWLEDGMENT AND AGREEMENT

By confirming a booking or submitting payment, the Client certifies that they:

  • Have read and understood this agreement in full
  • Accept the terms, risks, and responsibilities outlined herein
  • Are authorized to sign on behalf of all persons listed in the booking
